General Terms and Conditions (GTC) – Digital Dreamweaver

1. Parties and Acceptance

By purchasing or downloading any item offered on the Digital Dreamweaver website, you (the “Licensee”) agree to these General Terms and Conditions (GTC) and any additional licensing terms displayed for each product. The parties to this agreement are [Your Name / Brand] (“Licensor”) and the Licensee. Acceptance of these terms occurs automatically upon completing a purchase.

2. Purpose of the Contract

These terms govern the sale, licensing, and use of digital images from Digital Dreamweaver They define the rights, responsibilities, and limitations of both parties.

3. Website Information

• The prices shown on Digital Dreamweaver’s website are valid for the product listed at the time of purchase.

• All image previews, descriptions, and advertising are for informational purposes only.

• After purchase, the Licensee will receive:

• A confirmation email with the download link.

• Account access credentials to view purchase history.

• An automatically generated invoice.

• This confirmation + invoice constitutes legal proof of purchase.

• Purchases are considered irrevocable, except in cases of technical error or other exceptions stated in these terms.

• Digital Dreamweaver is not responsible for errors caused by incorrect data entry by the Licensee.

• Payment records may be used as evidence in disputes regarding purchase or use of images.

4. Purchasing Procedure and Validation

• All purchases must be completed through www.thedigitaldreamweaver.com.

• Completing a purchase constitutes acceptance of the license terms and GTC.

• If payment is successful, the license is granted immediately upon confirmation.

• Licenses are valid only for the image(s) purchased and do not transfer to other images unless separately purchased.

5. Licensing Terms

Licenses are single-image, JPEG format only.

Tiered Licenses:

Personal License – $14

• Permitted uses: personal projects, portfolios, blogs, social media (organic/unpaid), academic projects, internal presentations.

• Prohibited uses: commercial activity, client projects, paid advertising, reselling or redistribution, claiming image as your own.

• Limits: unlimited personal projects, perpetual use.

Commercial License – $39

• Permitted uses: everything in Personal License + client project (one client), online store display, paid advertising (limited), promotional printing up to 5,000 items, collaborations with influencers or affiliates.

• Prohibited uses: sharing editable image files, exceeding project limits without additional license, companies with more than five employees.

• Limits: 1 project per image, perpetual use, company size ≤5 employees.

Extended Commercial License – $189

• Permitted uses: everything in Commercial License + unlimited online/offline advertising, unlimited print for promotional materials, e-commerce product representation, digital templates/apps (images integrated, non-extractable), out-of-home advertising.

• Prohibited uses: reselling or redistributing image files in original form, using same image across multiple unrelated projects, companies with >50 employees.

• Limits: 1 project per image, perpetual use, company size ≤50 employees.

6. Delivery / Shipping

• Digital images are delivered immediately via download.

• No physical shipping applies unless explicitly stated.

7. Prices and Offer Validity

• All prices are in US dollar and include applicable taxes.

• Offers, discounts, and pricing are valid at time of purchase only.

8. Payment Methods

• Payments are accepted via PayPal, Visa, Mastercard, Amex, Discover, Apple Pay, etc.

• Payment must be completed before license is granted.

9. Right of Withdrawal / Refunds

• Due to the digital nature of images, all sales are final.

• Refunds or exchanges may only be granted in cases of technical error or defective files, at Digital Dreamweaver’s discretion.

10. Force Majeure

• Digital Dreamweaver is not liable for delays, errors, or interruptions caused by events beyond its control, including technical failures, natural disasters, or internet outages.

11. Nullity or Ineffectiveness of Clauses

• If any provision of these GTC is deemed invalid or unenforceable, the remaining provisions remain fully in effect.

12. Online Dispute Resolution

• Licensees should first contact Digital Dreamweaver to attempt resolution.

• If unresolved, disputes may be referred to mediation or arbitration under applicable law.

13. Applicable Law and Jurisdiction

• These terms are governed by the laws of  NY/USA.

• Any legal action must be brought in the courts of  NY/USA.

• These terms comply with relevant consumer protection, digital goods, and copyright legislation applicable in NY/USA.

15. Comments and Suggestions

• Licensees may provide feedback at vanessaharrison@graphic-designer.com.

• Submitting comments does not alter these terms.

• These GTC work together with the licensing terms for each image.

• By purchasing an image, you acknowledge that you have read and accepted both the license tier and these GTC.

• Violating any term automatically terminates the license.

• All images remain the intellectual property of Digital Dreamweaver.
